Terms of Service 

1. General

Felix Taylor, operating as a freelance designer (Freiberufler) under the name “Platten Haus” (“Platten Haus”, “we”, “us”), provides design, furniture, and related services. These Terms of Service govern all purchases and services unless otherwise agreed in writing. Any conflicting terms of the customer shall not apply unless expressly accepted in writing.

2. Purchasing

The photographs illustrating the products presented aim to reproduce them as faithfully as possible; however, they are non-contractual. Customers are advised to review the description of each product carefully in order to understand its essential characteristics before making a purchase. Most styles are unisex.

Unless otherwise stated orders are usually processed within 1–5 working days after receipt of the order. Delays may occur if orders are placed on days when operations are paused. We will make every effort to process orders as quickly as possible. In the event that an item is out of stock after an order has been placed, we will contact you via email.

3. Prices, VAT and International Orders

When shopping within the European Union, prices are indicated in Euro and include VAT (Value Added Tax) in accordance with German law. The applicable VAT rates in Germany are currently 19% for most goods and 7% for certain categories.

For orders shipped outside the European Union, prices are indicated without VAT. Duties, import taxes, and customs fees are not included and are the responsibility of the buyer. Orders are shipped with an accurate declaration of value; it is not possible to declare items as a “gift” or to declare a lower value than the purchase price.

Once a tracking number has been provided, it is the responsibility of the customer to monitor the shipment and ensure availability for delivery or timely collection from the carrier. If a shipment is returned due to failed delivery or non-collection, we do not assume responsibility. If a shipment is held in customs, the customer is responsible for contacting the carrier and paying any applicable fees.

4. Delivery and Address

Products will be delivered to the address provided by the customer at the time of ordering. Customers may choose to have their order delivered to an alternative address. It is the customer’s responsibility to ensure that the delivery address is accurate and complete.

Risk transfers to the customer upon delivery or collection.

5. Right of Withdrawal (Widerrufsrecht)

If you are a consumer within the meaning of § 13 BGB, you have the right to withdraw from your purchase within fourteen (14) days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you takes possession of the goods.

To exercise your right of withdrawal, you must inform us (Felix Taylor – Platten Haus, email: mail@platten.haus) of your decision to withdraw from the contract by means of a clear statement (e.g. email). To meet the withdrawal deadline, it is sufficient that you send your communication before the withdrawal period has expired.

In case of withdrawal, we will reimburse all payments received from you, including standard delivery costs, without undue delay and no later than fourteen days from the day on which we are informed about your decision. We may withhold reimbursement until we have received the returned goods or you have provided proof of return.

You must return the goods without undue delay and no later than fourteen days from the date on which you inform us of your withdrawal. You bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

The right of withdrawal does not apply to goods that are custom-made or clearly personalised.

6. Services and Project Work

Where Platten Haus provides design, fabrication or project-based services, these are governed by a separate agreement or design brief. Projects may be structured in stages, including concept development, technical development, and fabrication. Each stage may be treated as a separate contract and remunerated independently.

Any deliverables such as drawings, renderings, CAD files or prototypes are provided for the purposes defined in the relevant agreement. Such materials remain the intellectual property of Felix Taylor unless otherwise agreed.

7. Third-Party Suppliers

We may engage third-party suppliers, workshops, or service providers where required. Where such suppliers are involved, we act as coordinator unless otherwise agreed. We do not guarantee the performance of third-party suppliers beyond statutory requirements and are not liable for their delays or defects unless required by law.

8. Intellectual Property

All intellectual property rights, including designs, drawings, models, renderings, and technical documentation created by Platten Haus, remain the property of Felix Taylor. No transfer of ownership occurs unless expressly agreed in writing.

Clients are granted a limited, non-exclusive right to use the delivered work for its intended purpose. Any reproduction, modification, or third-party fabrication without written consent is prohibited.

9. Liability

We are liable without limitation in cases of intent, gross negligence, injury to life, body or health, or where liability cannot be excluded under applicable law. In cases of slight negligence, we are liable only for breaches of essential contractual obligations and limited to foreseeable damages.

We are not liable for indirect or consequential damages to the extent permitted by law. We are not liable for delays or defects caused by third-party suppliers, except where required by law.

10. Material Characteristics and Fabrication Standards

The customer acknowledges that natural and industrial materials used in Platten Haus products, including wood, stone and metals, have inherent characteristics and may change over time due to environmental conditions and normal use. This may include variations in colour, surface, patina, minor movement, or small scratches. Such characteristics do not constitute defects.

Where products are developed as part of a design project, materials, finishes and construction methods are defined in the applicable design brief. By approving a design stage or specification, the customer accepts these selections and their inherent characteristics.

Industrial fabrication processes involve standard tolerances and surface variations. Minor irregularities, including small scratches or marks consistent with professional fabrication and handling, do not constitute defects. If a specific finish or tolerance is required, this must be agreed in writing prior to fabrication.

11. Payment

Unless otherwise agreed, invoices are payable within seven (7) days. We reserve the right to suspend performance or withhold delivery in the event of late payment.

Ownership of goods remains with Platten Haus until full payment has been received.

12. Force Majeure

We are not liable for delays or failure to perform due to events beyond our reasonable control, including but not limited to supply chain disruptions, transport delays, material shortages, or governmental restrictions.

13. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If the customer is a business, the place of jurisdiction is the place of business of Felix Taylor. For consumers, statutory jurisdiction rules apply.

14. Final Provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in effect.
